Welcome to beBee. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and beBee PLATFORM S.L., a Spanish company with registered office at Calle de la Virgen de los Peligros 11, 3rd floor, 28013 Madrid, Spain (Tax ID: ESB84471838) ("beBee", "we", "our").
By registering, accessing, or using bebee.com and any of its applications, features, or associated services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any of these Terms, do not use the Services.
beBee is incorporated in Spain and operates exclusively as a European Union company, with no offices, employees, or legal representatives in any other country. These Terms are drafted under Spanish and EU law, which is the governing law of this agreement.
As an EU company serving users worldwide, beBee complies with EU and Spanish consumer protection and data protection laws. For users outside the EU, we describe in these Terms the consumer rights recognized by the laws of your country of residence as a matter of good practice and transparency, so that you understand what protections may apply to you.

For users outside the EU, we describe in these Terms the consumer rights recognized by the laws of your country of residence as a matter of good practice and transparency, so that you understand what protections may apply to you.
2. Definitions
- Platform: the website bebee.com and any associated mobile application or web service.
- User: any individual who registers or accesses the Platform, whether as a Candidate, Freelancer, Recruiter, or Company.
- Candidate: a User seeking employment or services through the Platform.
- Freelancer: a User who offers professional services through the Marketplace.
- Recruiter/Company: a User who posts job offers or seeks candidates.
- Content: any information, text, images, videos, data, files, or other material that a User posts, uploads, transmits, or makes available through the Services.
- User Content: Content created and published by Users.
- Premium Services: paid features that complement the free Services.
- Marketplace: the feature that allows Users to post service requests and Freelancers to submit proposals.
- Proposal: an offer submitted by a Freelancer in response to a service request.

beBee is a professional platform that enables its Users to:

beBee is not a recruitment agency or temporary employment company. beBee does not intervene in the employment or contractual relationship between Users, nor does it guarantee obtaining employment, hiring services, or any result derived from the use of the Platform.

- Search and browse job offers from multiple sources.
- Create a professional profile visible to other Users and recruiters.
- Apply for job offers.
- Set up personalized job alerts.
- Access indicative salary information.
3.2 Services Marketplace
- Post professional service requests.
- Submit proposals as a Freelancer.
- Manage communication between requesters and providers.
3.3 Content and Community
- Publish articles and professional content on the Platform blog.
- Create and manage a professional portfolio.
- Send and receive messages between Users.
- Post and receive professional reviews and ratings.
3.4 Market Information
- Access indicative salary data by profession, location, and experience level.
- Access informational pages about professions, skills, and labor markets.
beBee is not a recruitment agency or temporary employment company. beBee does not intervene in the employment or contractual relationship between Users, nor does it guarantee obtaining employment, hiring services, or any result derived from the use of the Platform.
4. Eligibility and Registration
4.1 Minimum Age
To register on beBee you must be at least 18 years old. By registering, you declare and warrant that you meet this requirement.

To access most Services you need to create an account. You can register via email and password, Google sign-in, or LinkedIn sign-in.
4.3 Accuracy of Information
You must provide truthful, accurate, and up-to-date information during registration and in your profile. It is prohibited to create fake accounts, maintain more than one active personal account, or provide false professional data.
4.4 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. You must immediately notify us of any unauthorized use at support@bebeecorp.com.

By creating an account, you expressly accept these Terms and our Privacy Policy. This acceptance constitutes an affirmative act of consent under the GDPR (Art. 7), LGPD (Art. 8), and other applicable data protection laws.

5. Your Account
5.1 Ownership
Your account is personal and non-transferable. You may not assign, sell, transfer, or share your account with third parties.
5.2 Professional Profile
When you create your profile, certain information will be visible to other Users according to your privacy settings. Contact information (phone, email, WhatsApp) will only be visible when the conditions established in our Privacy Policy are met.
5.3 Communications
By registering, you agree to receive service communications necessary for your account (verification, security, changes to the Terms). You can manage your optional communication preferences from your settings panel.
Your account is personal and non-transferable. You may not assign, sell, transfer, or share your account with third parties.

7. User Content

This license terminates when you delete your Content or your account.

You are solely responsible for the Content you publish. You represent that you hold the necessary rights, your Content does not infringe third-party rights, is truthful, and complies with applicable law.

beBee reserves the right to review, moderate, edit, or remove any Content that violates these Terms. beBee uses automated AI systems to assist with moderation, supplemented by human review.

You can delete your Content at any time from your account. Cached copies and backups may persist for a reasonable period.

The Marketplace is a space where Users can post service requests and Freelancers can submit proposals. beBee acts exclusively as a technology intermediary and is not a party to the contractual relationship between requester and provider.

Users can post requests describing the service they need. Requests must be lawful, truthful, and non-discriminatory.
8.3 Proposals
Freelancers can send proposals in response to requests. The number of monthly proposals may be limited by subscription level.
8.4 No Employment Relationship
beBee is not an employer, contractor, or agent of any Marketplace User.
8.5 Reviews and Ratings
Users can leave reviews and ratings after a service is provided. Reviews must be honest and based on real experiences.

9. Job Offers
9.1 Sources
beBee aggregates job offers from multiple sources, including direct postings and external sources (aggregators, job feeds, partner portals).
9.2 No Guarantee of Accuracy
beBee does not guarantee the accuracy, currency, or completeness of job offers, especially those from external sources. Salary data shown are indicative estimates.

Some offers redirect to external websites. By clicking, you leave the Platform and are subject to the destination site's terms.
9.4 Applications
When you apply to a direct offer, your profile information will be shared with the advertising company. beBee does not intervene in the subsequent selection process.
beBee aggregates job offers from multiple sources, including direct postings and external sources (aggregators, job feeds, partner portals).
9.2 No Guarantee of Accuracy
beBee does not guarantee the accuracy, currency, or completeness of job offers, especially those from external sources. Salary data shown are indicative estimates.

10. User Conduct
10.1 General Obligations
By using the Services, you agree to comply with applicable law, use the Services for legitimate professional purposes, provide truthful information, and respect the rights of other Users and third parties.
10.2 Prohibited Conduct
The following is expressly prohibited: creating fake profiles, identity impersonation, sending spam, scraping without authorization, using automated bots or scripts, interfering with Platform operations, publishing illegal or discriminatory content, posting fake job offers or those requiring payments from candidates, and attempting to access other Users' accounts.

beBee reserves the right to remove Content, suspend or cancel accounts, and take appropriate legal action.
By using the Services, you agree to comply with applicable law, use the Services for legitimate professional purposes, provide truthful information, and respect the rights of other Users and third parties.

11. Intellectual Property

All intellectual and industrial property rights over the Platform belong to beBee or its licensors. Reproduction or exploitation without authorization is prohibited.

"beBee" and associated logos are registered trademarks of beBee PLATFORM S.L.
11.3 Infringement Reports
If you believe any Content infringes your intellectual property rights, you can notify us at support@bebeecorp.com providing a description of the infringing content, proof of your rights, and your contact information. beBee will review and act on valid infringement notices promptly.
All intellectual and industrial property rights over the Platform belong to beBee or its licensors. Reproduction or exploitation without authorization is prohibited.

"beBee" and associated logos are registered trademarks of beBee PLATFORM S.L.

If you believe any Content infringes your intellectual property rights, you can notify us at support@bebeecorp.com providing a description of the infringing content, proof of your rights, and your contact information. beBee will review and act on valid infringement notices promptly.
12. Use of Artificial Intelligence
12.1 AI Systems
beBee uses artificial intelligence technologies to improve the Services, including automated content moderation, personalized job recommendations, profile classification, market rate suggestions, and informational content generation.
12.2 Automated Decisions
No decision that significantly affects your rights will be made exclusively by automated means. Automated moderation decisions can be reviewed by our team. You may request human review of any automated decision by contacting support@bebeecorp.com.

Job recommendations and search results are personalized based on your profile, location, search history, and preferences. The main parameters influencing recommendations are: relevance to your skills and experience, geographic proximity, recency of the offer, and job source quality.

AI systems may produce inaccurate results. Recommendations and estimates are indicative and do not constitute professional advice.

14. Service Availability
beBee will make reasonable efforts to keep the Platform continuously available, but does not guarantee uninterrupted availability of the Services. beBee reserves the right to modify, suspend, or discontinue any feature at any time. beBee is not a data storage service; Users are responsible for keeping copies of their important Content.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. beBee does not warrant that the Services will meet your specific requirements, be uninterrupted or error-free, or that job offers will result in employment.
This disclaimer does not affect your statutory consumer rights under the laws of your country of residence. In particular, consumers in the EU/EEA, UK, Australia, New Zealand, Brazil, Argentina, and other jurisdictions with mandatory consumer guarantees retain all rights provided by their local laws, which cannot be excluded or limited by contract.

16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, beBee shall not be liable for indirect, incidental, special, or consequential damages. beBee's total cumulative liability shall not exceed the greater of: (a) amounts paid by the User in the preceding 12 months; or (b) 1,000 euros.
These limitations do not apply in cases of death, personal injury, gross negligence, willful misconduct, or fraud. These limitations do not affect mandatory consumer rights under applicable law. In jurisdictions where limitations on implied warranties or exclusion of certain damages are not allowed, beBee's liability will be limited to the maximum extent permitted by law.

17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold beBee harmless against any claims arising from your use of the Services, your breach of these Terms, your infringement of third-party rights, or the Content you publish on the Platform.
This clause does not apply to consumers in jurisdictions where indemnification clauses in consumer contracts are prohibited or unenforceable (including, but not limited to, EU/EEA member states, Brazil, and Argentina).

By the User: You can cancel your account at any time from your profile settings or by contacting support@bebeecorp.com.
By beBee: beBee may suspend or cancel your account if you breach these Terms, your conduct harms others, your account has been inactive for a prolonged period, or it is necessary for security reasons. Where practicable, beBee will give you prior notice and an opportunity to remedy the breach before termination.
After cancellation, you will lose access to the Services and active Premium subscriptions will be cancelled. You may request export of your data before or within 30 days of termination.

19. Modifications to the Terms

If you disagree with the modified Terms, you may terminate your account before the effective date. Your continued use of the Services after the effective date will constitute your acceptance.
For Users in jurisdictions where unilateral contract modifications require explicit consent (e.g., Brazil — CDC Art. 51; Argentina — Ley 24.240 Art. 37), continued use after the notification period constitutes acceptance; if you do not agree, you may terminate your account and receive a pro-rata refund of any prepaid subscription.

20. Applicable Law and Jurisdiction

These Terms are governed by the laws of Spain and, where applicable, European Union regulations (GDPR, DSA, EU Consumer Rights Directive). However, mandatory consumer protection laws of your country of residence apply to you regardless of this choice of law.
20.2 Jurisdiction for EU/EEA/UK Consumers
If you are a consumer residing in the EU/EEA or UK, any dispute shall be submitted to the courts of your domicile, in accordance with Regulation (EU) 1215/2012 and applicable national law.
20.3 Jurisdiction for Latin American Consumers
If you reside in Brazil, Argentina, Colombia, Mexico, Chile, Peru, or another Latin American country with mandatory consumer venue rules, disputes shall be submitted to the courts of your domicile as required by your local consumer protection laws.

If you reside in the United States, any dispute arising from these Terms shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except for disputes that qualify for small claims court. You and beBee agree to waive the right to a trial by jury and to participate in class actions, class arbitrations, or representative proceedings. This arbitration clause is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). Either party may bring claims in small claims court if the claim qualifies. Nothing in this clause limits your right to seek injunctive relief in court.
20.5 Jurisdiction for Other Countries
For Users in countries not covered above, the parties submit to the jurisdiction of the Courts of Madrid (Spain), without prejudice to any mandatory consumer venue rules in your country of residence.

21. Digital Services Act (DSA) Compliance
In compliance with Regulation (EU) 2022/2065 (Digital Services Act):
21.1 Illegal Content Reporting
If you encounter content on the Platform that you believe is illegal, you can report it via support@bebeecorp.com. beBee will review all reports promptly and take appropriate action, including removal of content, within a reasonable timeframe.
21.2 Notice and Action
beBee will acknowledge receipt of your report and inform you of its decision and the reasons for it. You may appeal any content moderation decision by contacting support@bebeecorp.com.

beBee publishes an annual transparency report detailing content moderation actions, complaints received, and their outcomes.

You can file complaints through support@bebeecorp.com within a maximum period of 6 months. Complaints will be resolved within a maximum of 30 business days.
For Users in the EU/EEA: In compliance with the DSA, beBee processes complaints about content moderation decisions and publishes annual transparency reports. You may also refer your complaint to an out-of-court dispute settlement body certified in your member state.
For Users in Brazil: You may also file complaints with PROCON or through the national consumer platform consumidor.gov.br.
For Users in Argentina: You may also file complaints with the Dirección Nacional de Defensa del Consumidor or through COPREC (Conciliación Previa en las Relaciones de Consumo).
For Users in the EU/EEA: In compliance with the DSA, beBee processes complaints about content moderation decisions and publishes annual transparency reports. You may also refer your complaint to an out-of-court dispute settlement body certified in your member state.

23. General Provisions
These Terms, together with the Privacy Policy, constitute the entire agreement between the User and beBee. If any provision is declared void or unenforceable, the remaining provisions shall remain in full force. beBee's failure to exercise any right shall not constitute a waiver. beBee shall not be liable for non-compliance due to force majeure.
Severability: If any clause in these Terms is found to be unenforceable in a particular jurisdiction, it shall be modified to the minimum extent necessary to make it enforceable in that jurisdiction, or severed if modification is not possible, without affecting the validity of the remaining Terms.
