I possess a degree in Bachelor of Commerce and a Bachelor in Law (LLB) from Mumbai University. I have a relevant experience of 19 plus years and have worked with Allcargo Global Logistics Ltd; Maersk Global Services and Transworld Group.

I. Litigation Management

• Review progress of outstanding litigation and liaise with and manage external lawyers and attending court and travelling for the purpose. – also for customs
• Regular review of all on going litigation, risk assessment, review of strategies. - customs
• Updating on all current and new legislations, judicial pronouncement.
• Monitoring Litigation Management System on continuous basis and provide data/information for Legal Tracker.
• Offering legal advice to various divisions / departments as and when required.
• Co-ordinating legal issues with the Company's solicitors and counsels.
• Advising on all corporate and commercial laws.
• Interacting with the business process in proactively solving issues that may or could arise in the course of business.
• Initiating recovery proceedings under the Negotiable Instruments Act and the Contract Act.

II. Claims (Cargo & Vessel Claims): 

• Handling dry cargo, reefer cargo and multimodal transport liability claims.
• Assessing and registering the claims with respective Insurers.
• Holding third party liable for damages to the cargo.
• Effectively handling recovery of the claims from the responsible party.
• Preparing periodical MIS reports for the department.

III. Regulatory Compliance

• Formulate compliance check-lists to be used for the purpose of ensuring that all information required is provided accordingly.
• Assist in continuously monitoring compliance with statutory obligations and advise management accordingly.
• Prepare periodical MIS reports for the department.

IV. Contract Management

• Review all contracts or any other documentation where the Company has committed itself and assess legal implications that need to be brought to the executive management’s attention.
• Prepare, review and modify contractual instruments to assist and support various business activities.
• Negotiate, review and draft documentation for business transactions and prepare and advise on the necessary checklist to be adopted to ensure information is submitted on time.

Drafting and vetting of Agreements - Commercial Contracts/ Service Contracts such as:

a) To effectively oversee and monitor Contract Management System put in place.

b) Service Agreements c) International Agency Agreements for Freight Forwarding, Supply Chain Mgmt Agreements, Staffing Services Agreements, Security Services Agreements, C&F Agreements, Warehousing Agreements, Lease Deeds and Leave &Licence agreements.

d) Highlighting the unfavourable clauses that can have a bearing on the risk and suggesting alternatives that will be needed to mitigate the risk.

e) Developing and updating the standard versions of agreements for all jurisdictions.

f) Monitoring litigation pertaining to Civil (Arbitration, Customs, Consumer) and Criminal matters.

g) Briefing the Solicitors and counsels for opinions and Litigations

V`Customs

Replying Statutory Notices and filing replies and written statements to the Customs and Port notices.

Attending and appearing the personal hearings before the Office of the Commissioner of Customs.

Drafting written statements and reply to the statutory notices received from the Customs offices.

Follow up with lawyers for liaising with the govt. depts.

VI. Additional skills

• Demonstrate knowledge of, and experience with, laws dealing with government and/or commercial contract administration, particularly contract negotiation, preparation and administration;

• Ability to delicately solve sensitive matters.
